Raffle Terms & Conditions

 
  1. Binding Terms and Conditions: These are the terms and conditions of the DineForLanka Raffle being conducted by Kind Hearted Lankans (“Charity”) of 211/89 Roden Street, West Melbourne as a registered ACNC charity. By participating in the raffle, entrants acknowledge that they have read and understood these Terms and Conditions; and agree to be bound by them and, in the event of any claim or dispute, by the law of New South Wales, Australia. Entries must comply with these Terms and Conditions to be valid. All dates and times specified in these Terms and Conditions take place in Australian Eastern Standard Time (AEST).

  2. Eligibility Requirements: Entry is open to all residents of Australia, except for those residing in Western Australia and Northern Territory who are over 18 years of age. Office bearers (i.e. managers and directors) of the Charity, its related bodies corporate and their suppliers and agencies involved in this raffle are not eligible to enter this raffle, nor are their immediate relatives (including spouses, partners, siblings or children).  Kind Hearted Lankans reserves the right to exclude any invalid raffle ticket entries.

  3. Prize: two tickets to the DineForLanka Australian event at Brae (Victoria) on Sunday 20 October 2019, including flights being return economy flights for two from the winner's nearest capital city to Melbourne, as necessary, to the value of up to A$1,000 in aggregate and subject to flight availability and an overnight stay at one of Brae’s luxury guest suites (twin share) in Victoria, Australia on Sunday 20 October 2019. This prize donated by Brae includes breakfast, evening supper and a copy of Dan Hunter’s book ‘Recipes and Stories from the Restaurant’. The total value of the prize is $2,720. Travel insurance, flight transfers, spending money, vaccinations, beverages, meals in Melbourne (excluding the DineForLanka event and breakfast and evening supper provided by Brae), and any other additional activities are not included. Travel dates must be within Sunday 20 October 2019 to Monday 21 October 2019 inclusive. Travel cannot occur outside of these dates. The prize cannot be transferred or redeemed for cash.

  4. Raffle Period: The raffle commences on 6pm AEST, Thursday 1 August 2019 and concludes at 6pm AEST, Sunday 1 September 2019.

  5. Prize Draw: The prize will be drawn at GalaBid Pty Ltd on Monday 2 September 2019 at 12pm AEST. The first valid entry drawn will win 1st Prize. In the event that, for any reason whatsoever, a winner does not claim either of 1st Prize by 2 December 2019 (Unclaimed Prize) the Charity will at its discretion write to the relevant authorities and subject to any directions or necessary approvals from those relevant authorities seek confirmation that the Unclaimed Prize has been forfeited by the relevant winner and permission that the Unclaimed Prize may be sold and the proceeds applied in accordance with the Charity’s charitable purpose. Cash will not be awarded in lieu of the prize. The Charity’s decision in respect of the Prize Draw and any correspondence with the relevant authorities is final and no correspondence will be entered into.

  6. Winner Notification: The winner of the Prize will be notified in writing within 2 days after the draw on 2 September 2019. If an entrant's contact details change during the Competition Period, it is the entrant's responsibility to notify DineForLanka in writing at contact@dineforlanka.com.

  7. Exclusions and Liabilities: Any additional or ancillary costs associated with prize fulfilment (including but not limited to travel insurance, transfers, upgrades and booking amendments) are the sole responsibility of the winner. The Charity accepts no responsibility for any tax implications that may arise from acceptance by a winner of a prize. Entrants should seek their own independent financial advice in this regard. To the full extent permitted by the law, the Charity accepts no liability for any injury, damages, expenses or loss whatsoever (whether direct, indirect, special or consequential loss or loss of profits) to persons or property arising from or in connection with this raffle.

  8. Authorisations: Entrants to this raffle authorise DineForLanka and the Charity to collect, use and disclose their personal information for the purpose of administering the raffle. All entries become the property of the Charity. All entries will be entered into a database. The prize winner consents to DineForLanka and the Charity’s use of the winner's full name and other details for any promotional, marketing and publicity purposes in any media worldwide without any fee being paid to the winner. Information that the Charity is required to collect by law for the conduct of this competitions and funds raised as a result will be retained for a period of 7 years.

  9. Disqualification and Cancellation: If the Charity forms a reasonable view that an entry or the entry process for any entrant has been tampered with or otherwise does not comply with these Terms and Conditions, the Charity reserves the right to disqualify that entry at its sole discretion. If for any reason the Charity determines in good faith and at its sole discretion that this competition is not capable of running as planned due to any agent or event beyond the reasonable control of the Charity which might corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition or which may change the intended result or prevent or hinder its determination, including poor ticket sales, (Extenuating Circumstances) the Charity may at its sole discretion (subject to any directions or necessary approvals from the relevant authorities) vary, postpone, suspend , or cancel the competition at any time. In the event of cancellation, the Charity will use its best endeavours to recommence the competition on similar terms and conditions if, at its sole discretion, it is feasible to do so. No refunds of any amounts deposited will be issued in the event of cancellation or disqualification due to Extenuating Circumstances. If the raffle is not recommenced on similar terms and conditions when and as determined by the Charity, entrants will be entitled to a full refund for any raffle tickets purchased.

  10. The Charity’s decision on all aspects relating to this raffle is final (subject to any directions or necessary approvals from the relevant authorities) and no correspondence will be entered into. Failure by the Charity to enforce any of its rights at any stage does not constitute a waiver of those rights.
